You shouldn't have to be an attorney to read and understand a warranty, so we're spelling it out in good ol' fashioned people-eaze.

MANUFACTURER & INSTALLER BACKED

The Phoenix Lifetime PROT3CTION™ Warranty has 3 essential and connected coverages:products, workmanship, and labor. Our full coverage, triple warranty, ensures that you never get surprised by out-of-pocket expenses.

Warranty Term

Our warranty term is for the lifetime of the roof and warranty coverage extends to all customers who are subscribed to and actively participating in our Phoenix AutoPilot Maintenance Program which covers the complete cost of 5-year roof inspection and all maintenance costs related to product, labor, and workmanship.

Our Product Warranty

We warrant that our Phoenix Seamless Systems roof will not leak for the lifetime of your commercial roof as long as you're actively participating in our AutoPilot Maintenance Program, and as long as the system was installed and maintained according to our specifications by a Phoenix Master Systems Installer.

Our Workmanship Warranty

Our Phoenix Master Systems Installer warrants that the work performed on your project is in compliance with Phoenix installation specifications and that it's free from defects.

Our Labor Warranty

Our Phoenix Master Systems Installer warrants the costs of labor on your project.

Coverage & Assignability

Both the Phoenix Master Systems Installer and the owner of the property are covered by the Phoenix LIFETIME PROT3CTION WARRANTYtm. The warranty is not limited in assignability or transferability.

Remedy

If your roof ever leaks, assuming you're subscribed to our AutoPilot Maintenance program, your Phoenix Master Systems Installer will dispatch to your location to prevent further damage and to repair the leak. Your responsibility is to report the leak within 72 hours of discovery to minimize damage. Phoenix will supply the products to make the repair, and your Phoenix Master Systems Installer will supply the labor and workmanship, as promised.

Sudden & Accidental Damage

Storms, hail, tornadoes, and other damage known as "Acts of God" happen. When they do, that's what insurance is for. We're not an insurer and we're not your insurer's customer. That's you. We'll work with you through the claims process to make sure that your roof is repaired and that you never risk the loss of your warranty throughout the process.

Disrepair

If for some reason your roof has fallen into disrepair because a former owner unsubscribed to the AutoPilot Maintenance program, you can have it reinstated. The cost will include: 1) a roof assessment 2) the cost associated with the period between when the AutoPilot Maintenance program subscription ceased and the date it was reinstated 3) the cost of repair.

Remedy Outside the Scope of Warranty

There's an in-between area where things may happen that neither of us can control including:

(a) movement or cracking or other failure of the roof deck or building

(b) failure of any materials used in any roof base or insulation or materials other than the Phoenix products

(c) infiltration or condensation of moisture through the walls, copings, building structure, or surrounding materials

(d) system failure due to installation over cold storage or freezer buildings or buildings with high humidity conditions

(e) expansion or contraction of any counterflashing or metal work

(f) chemical attack on the system including, but not limited to, exposure to grease and oil

(h) architectural, engineering, or design defects or flaws

(i) impact of foreign objects, including damage caused by objects blown onto the roof by wind

If any of these things occur, your Phoenix Master Systems Installer will assess your roof, prepare a scope of work and estimate, and upon your work authorization approval, they'll repair your roof without impact on your warranty.

Claims Notification

Like in the "Remedy" paragraph, your responsibility is to report a claim within 72 hours of discovery directly to Phoenix Coatings, LLP (not your Master Systems Installer). You'll do so by emailing us at: Claims@Phoenix-Coatings.com. Our team will respond directly to you and we'll include your Master Systems Installer in all communications so that everyone knows exactly what's going on and there's never any room for misunderstanding.

Exclusions From Coverage

We have three exclusions from coverage, and we believe you'd exclude them too if you were in our shoes:

(3) If you refuse to have your Master Systems Installer inspect your roof every 5 years in order to maintain it, we won't warrant your roof.

(2) If something happens that causes ponding or prevents drainage after we've installed and warranted your roof, we won't warrant your roof.

(3) If you allow excessive traffic on your roof and it damages the Phoenix Seamless System, we won't warrant your roof.

These three issues can be prevented with good communication. As long as you're subscribed to our AutoPilot Maintenance program, #1 will never occur. The same thing applies to #2 and #3. If you have someone do work on your roof such as an electrical or HVAC contractor, give your Phoenix Master Systems Installer a heads up. Sure they'll charge you for the service call, but you'll never risk your warranty coverage.

LIMITATIONS OF DAMAGES | MEDIATION | JURISDICTION

Our warranty is our warranty. We're not covering anything else outside of what's stated in our warranty. If there are other damages to your building outside of what our warranty covers, most likely you need to bark up the tree of another contractor or company that failed you - and that company is not us.

Also, if you have a dispute, you're agreeing not to sue us. If a dispute over something occurs and we can't seem to work through it, we'll take it to a mediator to help keep thing constructive and amicable. And we'll do so in Avery County where we're headquartered because we're a national company and it just makes good sense.
